Terms of Service

Welcome to Branchstory ("Branchstory," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you or the entity you represent ("Customer," "User," or "you") and Branchstory. By registering an account, accessing, or using our reputation operations software, web dashboard, APIs, or integration services (collectively, the "Service"), you explicitly agree to be bound by these Terms and our Privacy Policy.

If you are entering into these Terms on behalf of a company, partnership, restaurant group, or other legal entity, you represent and warrant that you possess the full legal authority to bind that entity to these Terms. If you do not agree to these Terms, you must not access or use the Service.

2.1 Organization Accounts: To access Branchstory, you must register an account by providing accurate, complete, and current information, including full name, business entity name, verified work email, and secure credentials.

2.2 Multi-Tenant Role Isolation: Branchstory enforces strict Role-Based Access Control (RBAC). "Admin" users hold organization-wide authority over all branches, billing, and team memberships. "Manager" users are scoped strictly to their assigned branch location identifiers. You agree not to attempt to circumvent, bypass, or tamper with organization boundaries or location scoping mechanisms.

2.3 Credential Protection: You are responsible for safeguarding your login credentials and session tokens. You must immediately notify Branchstory of any unauthorized use of your account or any other breach of security.

3.1 External Platform Authorization: Branchstory allows organizations to connect external review platforms, specifically Google Business Profile. By connecting your Google account, you grant Branchstory permission to access, ingest, sync, and publish responses to customer reviews in accordance with your organization preferences.

3.2 Google API Services User Data Policy: Branchstory's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

3.3 OAuth Token Encryption & Disconnection: All OAuth tokens and refresh credentials are encrypted at rest using AES-256-GCM. You may revoke access or disconnect your Google Business Profile integration at any time through the Integrations panel in your Branchstory dashboard, which immediately ceases ongoing background synchronizations.

4.1 Advisory Nature: Branchstory incorporates artificial intelligence systems to synthesize customer feedback, cluster recurring operational complaints, and draft prospective review replies. Customer reviews remain the factual source material; AI categorizations, root-cause detections, and reply drafts are strictly hypothetical and advisory.

4.2 Mandatory Human Review: You acknowledge and agree that automated reply drafts and operational escalations must be reviewed and approved by an authorized human manager prior to publication or operational execution. Branchstory does not publish replies to external review platforms without explicit human confirmation.

5.1 Subscription Plans: Access to Branchstory is billed on a recurring monthly or annual subscription basis according to the plan tier selected (e.g., Starter, Business, Enterprise). Plan tiers include defined branch location quotas, team member allocations, and sync frequency allowances.

5.2 Free Trials: We may offer free trial periods (e.g., 14-day trial) for evaluation purposes. At the conclusion of the trial period, continued access requires an active paid subscription.

5.3 Taxes & Payments: All subscription fees are exclusive of applicable value-added, sales, goods and services, or other transaction taxes, which will be billed in accordance with applicable statutory regulations.

6.1 Cancellation by Customer: You may cancel your subscription at any time via the Settings or Billing page of your dashboard. Upon cancellation, your account will remain active through the end of the currently prepaid billing cycle, after which access to authenticated features will terminate.

6.2 Suspension & Termination: Branchstory reserves the right to suspend or terminate account access immediately without liability if we reasonably determine that you have violated these Terms, compromised platform security, attempted unauthorized cross-tenant data access, or engaged in abusive conduct.

6.3 Data Retention Post-Termination: Following cancellation or termination, you may request a complete export of your operational issues, review history, and location metrics. After thirty (30) days following account closure, all tenant data will be permanently purged in accordance with our Privacy Policy.

7.1 "As-Is" Provision: TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Third-Party Service Dependencies: Branchstory is not liable for service interruptions, data sync latencies, or API downtime resulting from third-party services, including Google Business Profile, underlying cloud hosting infrastructures, or upstream AI provider outages.

7.3 Liability Ceiling: IN NO EVENT SHALL BRANCHSTORY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE TOTAL FEES ACTUALLY PAID BY CUSTOMER TO BRANCHSTORY IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT GIVING RISE TO LIABILITY.

We may update these Terms periodically to reflect product evolutions, legal requirements, or integration changes. When significant modifications occur, we will notify you via email or through an in-app notice, and update the version and date at the top of this page.
